General conditions
1. Subject
These general terms and conditions govern the booking and rental of holiday accommodation offered on the website www.evolena.ch, which belongs to Agence EVOLENA Sàrl (hereinafter referred to as ‘the company’).
2. Reservation
2.1 Booking procedure: To make a booking, the user must complete the booking form available on the website. The booking will be confirmed by a confirmation e-mail sent by the company.
2.2 Payment: The booking will require payment of 50% of the total rental amount as a deposit. The balance must be paid 31 days before the arrival date. Payments can be made by bank transfer or credit card.
2.3 Cancellation policy: Cancellations must be notified in writing to info@evolena.ch. Refund conditions are as follows:
Cancellations up to 28 days (inclusive) in advance: refund of 50% of the prepaid amount.
Cancellations made 27 days or more in advance: no refund.
2.4 Without notice of cancellation and if, for any reason whatsoever (death, illness), the Tenant does not take possession of the rented accommodation or occupies it only partially, he/she is liable for payment of the full rental price stipulated in this contract, without being able to claim any deduction whatsoever. Cancellation insurance may be taken out by the tenant through the agency. The following are excluded from the insurance: illnesses and accidents that occurred prior to the conclusion of the lease. Cancellation must be notified to the agency within 48 hours of the reason for cancellation.
2.5 If the lease is concluded by correspondence or without a prior visit, the tenant undertakes in advance to accept the furnished accommodation as described in the offer. In the event of non-acceptance, the tenant may not demand a change of accommodation or a refund from the agency.
2.6 In the event of the sale of the rented property, no compensation may be claimed, whether from the agency, the former owner or the new owner. The lease is terminated upon signature of the deed of sale. However, the agency will do its utmost to offer the tenant replacement accommodation.
3. Arrival and departure
3.1 Check-in: the check-in time for the accommodation is from 3 p.m. to 6 p.m. on the day of arrival. If you plan to arrive outside these times, you must inform us in advance.
3.2 Departure: The departure time is set before 9.30 am on the day of departure. Late departures without prior agreement may result in additional charges.
4. Taking possession and occupation
4.1 On taking possession of the accommodation, the tenant will check its condition. If he finds any damage to the building or furniture, he will inform the agency within 48 hours of his arrival.
4.2 Number of occupants : The accommodation may only be occupied by the number of people specified in the booking. No additional guests are permitted without the prior agreement of the company.
4.3. Rules of coexistence: Guests must respect the rules of coexistence and civic behaviour, avoiding disturbing neighbours. No parties or events are permitted without prior authorisation.
4.4 Animals are not permitted unless authorised. Additional charge per animal CHF 60.
4.5 The agency or the owner reserves the right to visit the rented accommodation in an emergency or with prior notice.
5. Use of the accommodation
5.1 The accommodation is rented for residential purposes, to the exclusion of any other use; the tenant may not sublet it without the express authorisation of the lessor. The Tenant wishing to stay with elderly or disabled persons is obliged to enquire about access facilities before entering into the lease.
5.2 Responsibility: Guests are required to maintain the accommodation in good condition and to report any damage or malfunctions immediately.
The tenant must comply with the house rules and police regulations.
In winter, for safety reasons, the tenant must ensure that pedestrian entrances are well maintained and clear snow from balconies.
The Tenant is responsible for the furniture and all appliances in the accommodation, such as electrical installations, heating appliances, baths and WCs, etc. He/she must maintain them so that they are in perfect condition when he/she leaves, with the exception of normal wear and tear. On the one hand, the tenant undertakes to take all necessary precautions to avoid damage of any kind (water, electricity, frost, etc.) and, on the other hand, to cover the costs resulting from negligence on his/her part or on the part of the other occupants of the accommodation.
During his stay, the tenant will maintain the accesses to the rented accommodation, clean the accommodation regularly, dispose of household rubbish in special bags on sale in grocery shops or supermarkets and deposit it in the areas provided for this purpose, glasses in the glass containers and paper in the paper containers. He or she will also be responsible for washing and tidying the dishes, and keeping the cupboards and fridge clean.
The cooker and oven will be cleaned after each use.
Final cleaning of the accommodation is included in the rental price. Furniture, decorative objects, etc. must remain in their original place; it is forbidden to exchange crockery and other objects from one property to another.
The tenant declares that he/she is insured for civil liability and, on request, will provide the agency with the address of his/her insurance company.
5.3 Prohibitions: It is forbidden to smoke inside the accommodation, as well as any illegal or dangerous activity.
5.4 On departure, the tenant must clean the cupboards and leave the crockery clean and tidy according to the order on arrival or according to the inventory, clean the oven and dispose of rubbish (in official plastic bags) in the areas provided for this purpose, glasses in the glass containers and paper in the paper containers.
The tenant undertakes to report any lost, destroyed or damaged items on departure. Any undeclared, unpaid breakages found after departure will be invoiced or deducted from the security deposit.
If, on departure, the accommodation is left in a condition that does not correspond to normal use, supplements will be charged for special cleaning, stained carpets, etc. An additional hour's cleaning will be charged at CHF 50.-
5.5 The term of the lease may not be extended without the Agency's express authorisation. Any tacit renewal within the meaning of Article 268 of the Swiss Federal Code of Obligations is excluded.
6. Services included
6.1. The rent includes the services of water, heating, electricity (except for long periods) and final cleaning (for normal use), VAT, unless otherwise indicated in the reservation.
6.2. Please refer to the description of the accommodation for details of its equipment.
6.3 The parking spaces or garages indicated in the general description are included in the price of this contract. The agency will advise the tenant on the parking of additional vehicles.
7. Liability of the Proprietor
7.1 The Proprietor shall not be liable for any damage or loss suffered by Guests during their stay, unless such damage or loss is directly attributable to the Proprietor's negligence.
7.2. In the event of force majeure (fire, flood, etc.) preventing the use of the accommodation, the owner undertakes to refund all sums paid by the guests.
7.3 EVOLENA Sàrl is not responsible for any irregularity in the supply of water, electricity, heating, etc., and generally declines all responsibility for any lack of use of the accommodation through no fault of its own.
8. Data protection
